In one way or another, we incur debt for a variety of reasons. We may obtain a loan for medical care, get a loan for a business, purchase goods on credit, or use our credit cards for certain emergencies. If we pay these debts in a timely manner, then there isn't much of a complication on the collection process for this stays solely between the debtor and creditor only.
However, if a debtor defaults on his payments, tends to avoid paying, or just plainly has no intention of paying back the loan, then the creditor seeks for another alternative.

In most cases, the creditor transfers the task of payment collection to a debt collection agency or to debt collectors.

There has been an abundant amount of evidence concerning the abusive collection practices being committed by debt collectors. They often practice unfair and deceptive debt collection practices by harassing the debtor. The use of profane language is unacceptable and considered abusive. Others use threat and even a few to the point of violence causing not only physical harm but harm to reputation as well.

These debt collectors even annoy debtors with repeated collection calls to the point of irritating and annoying them. These unfair practices have caused debtors to spend sleepless nights thinking how to pay off their debts. Far worse, these practices have caused loss of jobs for some individuals, marriage problems, broken families, invasion of privacy and even bankruptcy.

It is indeed the responsibility of a debtor to pay for his unpaid debts and they are obligated to answer for it. After all, they are the ones who used the said proceeds of the loan and they benefited from it. But these debtors are protected by certain rights against these debt collectors using unfair collection practices. It is of utmost importance that if you yourself are a debtor, you are well aware of your rights and refrain from letting yourself be a victim. Do not let these debt collectors harass and prey upon you. Sure, it is part of their job, but often their actions are just beyond acceptable.

Knowing the proper procedure in debt collection could help a debtor avoid being harassed and enable a debt collector to do his job appropriately. The Fair Debt Collection Practices Act protects both debtor and collector and both should well be aware of the consequences that may result from their actions.
